SUBJECT: Approval of a Statement of Service with Park Planet, in the Amount of $108,208.63, for a Measure Y Funded Project to Replace Playground Equipment at Dennis Chavez Memorial Park CP250044 and Diego Rivera Park CP250043

Considers approving a Statement of Service with Park Planet for a Measure Y funded project to replace playground equipment at two parks in South Merced.
RECOMMENDATION
City Council - Adopt a motion:
A. Waiving the City’s competitive bidding requirement as permitted by Merced Municipal Code section 3.04.210 for standardizing existing park equipment; and,
B. Approving a Statement of Service with Park Planet in the amount of $108,208.63 for playground equipment at two (2) parks and approving change orders up to 10% of the contract price; and,
C. Authorizing the City Manager to execute the necessary documents.

DISCUSSION
The project consists of, in general, phase 2 of the Dennis Chavez Memorial Park (secondary playground structure) removal of existing play equipment and supply and installation of new playground equipment, as well as the installation of a swing set at the Diego Rivera Park.
At the May 1, 2023, Council meeting, Council awarded the proposal and approved a Statement of Service with Park Planet for replacement of playground equipment at both the Dennis Chavez Memorial Park and Diego Rivera Park. At the time, due to budget constraints, only half of the playground equipment was replaced with the thought of requesting additional funding in the next fiscal year to complete the remainder. The remaining playground structure at Dennis Chavez Memorial Park is dated and needs to be replaced, as well as the addition of a swing set at Diego Rivera Park to complete both park projects. By continuing to use Park Planet, benefits will include parts interchangeability, reduced parts inventory, and standardizing equipment.
After careful consideration, staff recommends Council waive the city’s competitive bidding requirement for standardization and approve the Statement of Services to complete replacing the playground equipment utilizing Park Planet to streamline existing equipment at both parks.
IMPACT ON CITY RESOURCES
This project was established as a Capital Improvement Project. Fund 2004-Measure Y Parks & Recreation, projects CP250044 & CP250043, contain sufficient funding to complete the project.
