SUBJECT: Adoption of Resolution Approving the Administering Agency State Program Supplement No. F041 and Agreement Summary (E-76) for a Congestion Mitigation & Air Quality Program (CMAQ) Grant CML-5085(064), (Project No. CP260052), CMAQ Sidewalks on West Ave., Fig Ave., and Home Ave. Project, for the Use of $46,920 in CMAQ Grant Funding for Preliminary Engineering
REPORT IN BRIEF
Considers a resolution approving a California Department of Transportation Program Supplement for the use of $46,920 in CMAQ Grant funding for Preliminary Engineering for the sidewalk infill project located on West Ave., Fig Ave., and Home Ave.
RECOMMENDATION
City Council - Adopt a motion:
A. Adopting Resolution 2026-27 a Resolution of the City Council of the City of Merced, California, approving Federal-Aid Projects Program Supplement Agreement No. F041; and,
B. Accepting CMAQ grant funds in the amount of $46,920 for preliminary engineering costs associated with the design of the CMAQ Sidewalks on West Ave., Fig Ave., and Home Ave. Project; and,
C. Increasing revenue in the amount of $46,920 and appropriating the same in Fund 5005-Street and Signal CIP; and,
D. Approving the use of pooled cash until reimbursement is received from the grant; and,
E. Authorizing the City Manager to execute the necessary documents.

Caltrans Procedures for Administering Local Grant Projects in the State Transportation Improvement Program (STP) are used to comply with the changes to the programming and funding statutes brought about by Charter 622 of the Statues of 1997 (SB 45, KOPP). The procedures have been modified to remain consistent with and complimentary to the various guidelines and policies adopted by the California Transportation Commission (CTC), including the current 2010 STP Guidelines
(adopted on October 14, 2009).

DISCUSSION
In October 2024, the City applied for Congestion Mitigation & Air Quality (CMAQ) program funds to install 5-foot-wide sidewalks located on West Avenue, Fig Avenue, and Home Avenue. The application was initially placed on a waiting list by Merced County Association of Governments (MCAG) and would be amended in an upcoming FTIP if funding became available. Earlier this year MCAG notified staff that this CMAQ project was added to FTIP Amendment No. 11.
The scope of this project is to install 5-foot-wide sidewalks and accessible ramps where necessary at the following locations:
• East side of West Avenue from 1st Street to 2nd Street
• East side of West Avenue from Childs Avenue to Riggs Avenue
• Both sides of Fig Avenue from T Street to S Street
• Both sides of Home Avenue from West Avenue to S Street
This portion of the project is for Preliminary Engineering, which will allow for design, preparation of engineering plans and specifications, environmental review, and public outreach. The Federal-Aid Projects Program Supplement Agreement No. F041 allows $46,920 in grant funds and a local match of $6,080 toward the Preliminary Engineering of this project.
IMPACT ON CITY RESOURCES
Staff recommends accepting grant funds from the State of California adopted Congestion Mitigation and Air Quality (CMAQ) Program, increasing revenue in Fund 5005 in the amount of $46,920 and appropriating the same to Fund 5005 -CP260052 for related design costs. Additionally, Measure V Funds will be used to meet the match requirement of $6,080.
This budget amendment will require an affirmative vote of five council members to pass.
