SUBJECT: Approval of Additional Contingency in the Amount of $35,144.66 for Additional Work Which is Reflected in the Final Change Order #5 with Rolfe Construction Inc. for G Street Improvements - Childs Ave to 13th Street, Project No. CP170039 to Close out the Project
REPORT IN BRIEF
Considers approving an increase to the contingency in the amount of $35,144.66, for Project No. CP170039 - G Street Improvements, Childs Ave to 13th Street, and Approving Change Order #5 with Rolfe Construction Inc. This increase will be the final increase to close out the project.
RECOMMENDATION
City Council - Adopt a motion:
A. Approving Change Order 5 with Rolfe Construction Inc. with an increase in contingency of $35,144.66 for a total contract contingency amount of $438,281.76, which is approximately 17.314% of the original contract amount; and,
B. Authorizing the City Manager to execute the necessary documents; and,
C. Authorizing the Finance Officer to make necessary budget adjustments.

AUTHORITY
Charter of the City of Merced, Article XI, Section 1109 - Contracts on Public Works, and Merced Municipal Code Chapter 3.04, Article IV - Public Works Contracts.
CITY COUNCIL PRIORITIES
As provided for in the 2023-24 Adopted Budget.
DISCUSSION
On December 20, 2021, Council awarded the G St Improvements project in the amount of $2,531,371 to Rolfe Construction for work including: Full Depth Reclamation (FDR) and installation of asphalt paving, ADA ramps, sidewalk, alley repaving, and commercial driveway approaches. It also includes water and sewer main installation in the alleys, replacement of water meters, sewer laterals and concrete valley gutters. The project is located on G Street, from Childs Avenue to 13th Street, the alley between 12th Street and 13th Street from I Street to G Street and the alley between 11th Street and 12th Street from MLK Jr. Way to G Street in the City of Merced, California.
On October 17, 2022, the contingency amount was increased by $150,000 to cover additional costs for a 10” water main replacement, additional curb and gutter removal and installation, and storm drain installation. The initial contingency amount of $253,137.10, and additional approved contingency of $150,000, totaled $403,137.10, and was paid to Rolfe Construction through Change Order #1, 2, 3, and 4. The extra work totaled $392,266.26, leaving a remaining contingency balance of $10,870.84, and consisted of the following:
Change Order 1: $98,500.00
1. Replace Astro turf landscaping to decomposed granite, and,
2. Additional signage
Change Order 2: $8,392.00
1. Additional potholing
Change Order 3: $466,726.80
1. Removal of tree wells,
2. Additional installation and removal of concrete curb and gutter,
3. Addition of storm drain, and,
4. Replace 10” water main.
Change Order 4: $15,647.46
1. Addition of DLC bike loop cable, and,
2. Additional water materials.
Change Order 5 and the additional contingency amount will be the final increase to close out the project. The increase in the contingency for the G Street Improvements - Childs Ave to 13th Street project by $35,144.66 is due to the following:
1. Additional concrete sidewalk work required for new roadwork. ($46,015.50)
The City of Merced Engineering Department recommends the approval of additional contingency in the amount of $35,144.66 to rectify damaged curb and gutter on G St, North of 13th St and close out the project.
IMPACT ON CITY RESOURCES
Project CP170039 was established as a Capital Improvement Project to be funded by Measure C, Sewer and Water Enterprise, RSTP, LTF, and SB1. There is sufficient funding in the project to complete this change order, utilizing the Streets & Signals Fund.
