SUBJECT: Award Bid to N&S Tractor for the Purchase of One New 24-Foot Hydraulic Folding Disk and One New 20-Foot Hydraulic Folding Laser Drag Scraper for a Total Cost not to Exceed $191,300 for the Wastewater Treatment Plant Land Application Division
REPORT IN BRIEF
Considers awarding the bid to N&S Tractor for the purchase of one new 24-foot hydraulic folding disk and one new 20-foot hydraulic folding laser drag scraper for the Wastewater Treatment Plant Land Application Division in a not to exceed amount of $191,300.
RECOMMENDATION
City Council - Adopt a motion:
A. Awarding the bid to N&S Tractor for the purchase of one new 24-foot hydraulic folding disk and one new 20-foot hydraulic folding laser drag scraper for a total amount not to exceed $191,300; and,
B. Authorizing the City Manager or the Deputy City Manager to execute the necessary documents, the City Buyer to issue the Purchase Order(s), and approval of change orders not to exceed 10% of the total purchase price.

AUTHORITY
Charter of the City of Merced, Article XI, Section 1111-Competitive bidding, and Merced Municipal Code Chapter 3.04, Article III - the purchase of materials, supplies, equipment, and contractual services of an estimated value greater than thirty-seven thousand dollars ($37,000), the "contract threshold," shall be made by the purchasing supervisor by written contract with the lowest responsible bidder.

DISCUSSION
Staff prepared bid specifications for one 24-foot folding hydraulic disk and one 20-foot hydraulic folding laser drag scraper; and the invitation for bids was advertised both in the Merced County Times newspaper and on the City’s website. Bids were publicly opened on August 24, 2023, with the following result:
• N&S Tractor $191,300.00 (only submittal received)
This farm equipment was included in the FY 2023/24 budget as replacements for existing equipment that has reached its useful lifespan and the sole bid received is below the budgeted amount. Staff recommends awarding the bid for both farm implements to N&S Tractor.
IMPACT ON CITY RESOURCES
The farm implements were approved in the FY 2023/24 adopted budget; no additional funding is needed. The implements will be purchased using funds budgeted in Fund 6000-Wastewater System Operation and Land Application Division (Account 60006085-590002).
