SUBJECT: Adoption of Amended Resolution for the Public Facilities Impact Fee Administrative Policy A-32
REPORT IN BRIEF
Amend Resolution 2022-07, adopted by City Council on February 7, 2022, to correct omissions in Exhibit A (Administrative Policy A-32) that did not reflect changes adopted previously by City Council on October 18, 2021.
RECOMMENDATION
City Council - Adopt a motion approving Amended Resolution 2022-07, An Amended Resolution of the City Council of the City of Merced, California, Amending Administrative Policy and Procedure A-32 Regarding Public Facilities Impact Fees.

AUTHORITY
Merced Municipal Code Section 17.62 (Public Facilities Impact Fees) calls for the adoption of an Administrative Policy to spell out implementation policies and procedures.

DISCUSSION
On October 18, 2021, the City Council adopted Resolution #2021-93, which made several minor amendments to the Administrative Policy A-32 for the Public Facilities Impact Fees to lengthen the time frame for demolished structures to be rebuilt from 5 to 15 years, allowing multi-family fees to be deferred, and allowing bonds to be used as security.
On February 7, 2022, the City Council introduced Ordinance No. 2537 to amend the Public Facilities Impact Fee Ordinance and adopted Resolution #2022-07 to amend the Administrative Policy for the Impact Fees. (Those amendments were more substantial and included changes to the definitions, new fee reductions, and other changes.) Although the red-lined version of the Administrative Policy included in the Administrative Report reflected the previous changes from October 2021, the “clean” version attached as Exhibit A of the adopted Resolution #2022-07 did not. City staff recently noticed the omissions and is now asking the Council to adopt an Amended Resolution at Attachment 1 that reflects both the changes made in October 2021 and the additional changes made in February 2022.
