REPORT IN BRIEF
Considers approving a supplemental appropriation in Fund 558, and approving a two-year agreement, with option to extend, with Restore Merced for litter abatement services of designated areas, in a total amount not to exceed $185,100 per contract year.
RECOMMENDATION
City Council - Adopt a motion:
A. Approving a supplemental appropriation from the unreserved, unencumbered fund balance for Fund 558 - Refuse Enterprise in the amount of $65,100; and,
B. Approving an agreement for services with Restore Merced in the amount not to exceed $185,100 annually for litter abatement services of designated areas for a period of two years, with an option to extend for two additional one-year periods; and,
C. Authorizing the Finance Officer to make the necessary budget adjustments; and,
D. Authorizing the City Manager or designee to execute the necessary documents and execute future contract amendments.

AUTHORITY

Services with an estimated value greater than $33,000.00 are made by written contract in accordance with Merced Municipal Code, Title 3 - Revenue and Finance, Chapter 3.04.

DISCUSSION
Per the City Council recommendation, a program for a 3rd party litter abatement service was added to the Solid Waste Division’s auxiliary services during the solid, organic and recycling waste rate study. The proposed scope of services target “hot spots” where additional litter abatement services would be useful throughout the city, with designated areas having monthly or weekly service, and with an option for on-call service when needed.
On April 19, 2021, staff solicited proposals from qualified litter abatement service vendors to provide the removal and disposal of litter/trash/debris from specified areas throughout the City of Merced. One proposal was received by the submittal deadline from Restore Merced in the amount of $185,100 per fiscal year.
With approval of the proposed rates for fiscal years 2021-2025, an amount of $120,000 per fiscal year was allocated for 3rd party litter abatement. Since litter abatement services were not contracted during the first fiscal year of the rate study, the $120,000 set aside in Fiscal Year 2020/2021 can be utilized to fund the proposed contract which is $65,100 per year above the budgeted amount of $120,000.
Upon review of the proposal, staff recommends entering into an Agreement for Professional Services with Restore Merced for two years, with the possibility of two one-year extensions.
IMPACT ON CITY RESOURCES
Funding in the amount of $120,000 is included in the adopted budget for Fund 558. A supplemental appropriation of the remaining $65,100 is needed to fund the proposed agreement for FY 2021/2022. Future funding will be incorporated with the budget process for each of the contract year.
