SUBJECT: Administering Agency Amendment Modification Summary (E-76) for a Congestion Mitigation and Air Quality Improvement (CMAQ) Grant CML-5085(051) for Use of $80,600 in Post-Programming CMAQ Carryover Apportionment to Supplement the Construction Phase Funding for Project No. CP200043 - Sidewalks Along Olive Avenue, Parsons Avenue, Alexander Avenue, and Hansen Avenue

Considers accepting $80,600 in Post-Programming CMAQ Carryover Apportionment for construction of sidewalks and ADA ramps on Olive Avenue from East Queen Circle to Parsons Avenue, Parsons Avenue from Olive Avenue to South of Hansen Avenue, and along Alexander Avenue from Nottingham Lane to Parsons.
RECOMMENDATION
City Council - Adopt a motion:
A. Accepting Post-Programming CMAQ Carryover Apportionment funds in the amount of $80,600; and,
B. Approving a budget amendment increasing revenue in Fund 5005-Street and Signal CIP in the amount of $80,600 and appropriating the same to Project No. CP200043 for costs associated with the construction of sidewalks on Olive Avenue, Parsons, Avenue, Alexander Avenue, and Hansen Avenue; and,
C. Approving the use of pooled cash until reimbursement is received from the grant; and,
D. Authorizing the City Manager to execute the necessary documents.

Caltrans Procedures for Administering Local Grant Projects in the State Transportation Improvement Program (STP) are used to comply with the changes to the programming and funding statutes brought about by Charter 622 of the Statutes of 1997 (SB 45, KOPP). The procedures have been modified to remain consistent with and complimentary to the various guidelines and policies adopted by the California Transportation Commission (CTC), including the current 2010 STP Guidelines
(adopted on October 14, 2009).

DISCUSSION
In December 2018, the City applied for Congestion Mitigation and Air Quality Improvement (CMAQ) funds to design and construct 5-foot sidewalks to provide connectivity along Olive Avenue from East Queens Circle to Parsons, along Parsons from Olive Avenue to just south of Hansen Avenue, and on Alexander Avenue from Nottingham Lane to Parsons to fill a sidewalk gap that currently exists. ADA ramps will be installed where necessary.
Appropriation was made at the August 5, 2019, Council Meeting for accepting CMAQ grant funds in the amount of $70,087 for Preliminary Engineering costs associated with the design, preparation of engineering plans and specifications, and environmental review.
Appropriation was made at the January 16, 2024, Council Meeting for accepting CMAQ grant funds in the amount of $402,998 for Construction costs associated with installation of sidewalks and ADA ramps.
Staff prepared plans and specifications, the project was advertised for bids, and City Council awarded the project to Fortis General Construction, Inc., in the amount of $662,080.73 on May 20, 2024.
At that same meeting a supplemental appropriation of $376,564 of Measure V funding from CP230003 (Yosemite Ave - M St to R St) was also approved. The Engineering Department will transfer back $80,600 of Measure V to CP230003 (Yosemite Ave - M St to R St) after Council accepts this apportionment.
At the request of the Engineering Department, Merced County Association of Governments approved the usage of the Region’s CMAQ Carryover Apportionment in the amount of $80,600 to supplement the construction phase of the installation of sidewalks at Olive Ave., Parsons Ave., and Alexander Ave.
IMPACT ON CITY RESOURCES
Project CP200043 was established as a Capital Improvement Project to be funded by Measure V and CMAQ funds. A budget transfer will be initiated to transfer $80,600 of Measure V back to CP230003 (Yosemite Ave - M St to R St) after Council approval. There are sufficient funds available to complete this project.
This budget amendment will require an affirmative vote of 5 Council Members to pass.
