Considers approving a supplemental appropriation from the unreserved, unencumbered fund balance from 1017-Economic Development Opportunity in the amount of $100,000 and transferring $250,000 from Fund 5003-Airport Industrial Park, for a total amount of $350,000 for the design phase of the new fuel storage and bulk loading/unloading system at the Merced Regional Airport.
RECOMMENDATION
City Council - Adopt a motion:
A. Approving a supplemental appropriation from the unreserved, unencumbered fund balance of Fund 1017-Economic Development Opportunity in the amount of $100,000, transferring to Fund 5006 Airport CIP and appropriating the same to the Fuel Farm Project CP220067; and,
B. Approving the transfer of $250,000 from Fund 5003-Airport Industrial Park Projects to be Determined to Fund 5006 Airport CIP in the amount of $250,000 and appropriating the same to the Fuel Farm Project CP220067.

As provided for in the 2024/2025 Adopted Budget.
DISCUSSION
The City received a notice from the State Water Resources Control Board (Attachment 1) mandating permanent closure of all single-walled underground storage tanks on or before December 31, 2025, at the Merced Regional Airport. To comply, we received a proposal from RS&H California Inc., to design the removal and installation of new fuel storage and bulk loading/unloading system (Attachment 2). RS&H’s design proposal amounts to $323,394. The approval to supplement the $350,000 from the Airport Industrial Fund and the Economic Development Opportunity Fund allows City staff to move forward and retain compliance with the Control Board’s requirement.
RS&H California Inc. has a current on-call agreement with the Engineering Department with a not to exceed amount of $750,000 to perform, planning, engineering, and environmental services for the Merced Regional Airport. (Attachment 3). After Council approval of this supplemental appropriation, an Authorization of Services agreement will be executed with RS&H to start the design to keep the City compliant with the State Water Resources Control Board mandate.
Economic Development Opportunity Fund: On April 2, 2018, the City Council adopted Resolution 2018-20, A Resolution of the City Council of the City of Merced, California, adopting Economic Development Opportunity Fund Policy, establishing the terms in which funds from the Fund may be used (Attachment 4). The Fuel Farm Project is seen a capital improvement project complying with Policy (h) “To fully utilize existing real estate, real property, existing or planned infrastructure, facility or capital improvements.
Essential Service: Pilots, the Fixed Based Operator, and the City rely on the sales of fuel as priority function of the Merced Yosemite Regional Airport.
IMPACT ON CITY RESOURCES
Staff is seeking approval of a supplemental appropriation from the unreserved, unencumbered fund balance from 1017-Economic Development Opportunity in the amount of $100,000 and transferring $250,000 from Fund 5003-Airport Industrial Park Projects to be determined, for a total amount of $350,000 to the Fuel Farm Project CP220067.
This will require an affirmative vote of five Council Members to pass.
