SUBJECT: Administering Agency Amendment Modification Summary (E-76) for a Congestion Mitigation and Air Quality Improvement (CMAQ) Grant CML-5085(049) for Use of $114,842 in Post-Programming CMAQ Carryover Apportionment to Supplement the Construction Phase Funding for Project No. CP190043 - Motel Drive Multi-Use Path
REPORT IN BRIEF
Considers accepting $114,842 in Post-Programming CMAQ Carryover Apportionment for construction of an eight-foot-wide concrete pedestrian/bicycle multi-use pathway along Motel Drive from Merced Avenue to Carol Avenue.
RECOMMENDATION
City Council - Adopt a motion:
A. Accepting Post-Programming CMAQ Carryover Apportionment funds; increasing revenue in Fund 5005-Street and Signal CIP in the amount of $114,842 in Fiscal Year 2023-24 and appropriating the same to Project No. CP190043 for costs associated with the construction of the Motel Drive Multi-Use Path; and,
B. Approving the use of pooled cash until reimbursement is received from the grant; and,
C. Authorizing the City Manager to execute the necessary documents.

Caltrans Procedures for Administering Local Grant Projects in the State Transportation Improvement Program (STP) are used to comply with the changes to the programming and funding statutes brought about by Charter 622 of the Statutes of 1997 (SB 45, KOPP). The procedures have been modified to remain consistent with and complimentary to the various guidelines and policies adopted by the California Transportation Commission (CTC), including the current 2010 STP Guidelines
(adopted on October 14, 2009).

DISCUSSION
In November 2016, the City applied for Congestion Mitigation and Air Quality Improvement (CMAQ) funds to install approximately 1,314 linear feet of multi-use path (sidewalk and bicycle lanes), corresponding curb and gutter and ADA compliant curb ramps and driveway on Motel Drive from Carol Avenue to Merced Avenue.
Appropriation was made at the July 2, 2018, Council Meeting for accepting CMAQ grant funds in the amount of $53,983 for Preliminary Engineering costs associated with the design of the multi-use path.
In July 2021, the City requested a 2 year time extension for the project due to the Covid pandemic.
Appropriation was made at the October 3, 2022, Council Meeting for accepting CMAQ grant funds in the amount of $508,347 for Construction costs associated with the multi-use path.
Staff prepared plans and specifications, the project was advertised for bids, and City Council awarded the project to Redstone Construction, Inc., in the amount of $993,059 on November 7, 2022. The project was completed in January 2024.
During the final closeout process for this project, staff was made aware by Caltrans that additional post-programming funding was still available and were advised to submit a modification to gain approval for the additional post-programming funding. November 2024, staff received the updated E-76 with the additional post-programming funding of $114,842.
Once the funding is appropriated, staff will calculate the amount of grant that can be invoiced based off the approved Caltrans percentage and submit the final invoice to Caltrans for reimbursement. After final calculations from the Finance Department, the Measure V that was already expensed for the final construction invoices will be reimbursed back into the project, due to the construction portion of the project being complete.
IMPACT ON CITY RESOURCES
Project CP190043-CMAQ Motel Dr Multi-Use Path was established as a Capital Improvement Project to be funded by Measure V and CMAQ funds. There are sufficient funds available to complete this project.
This budget amendment will require an affirmative vote of five council members to pass.
