RECOMMENDATION
City Council - Adopt a motion:
A. Awarding the R St. Sidewalk Replacement Childs Avenue To 13th Street, Project No. CP220024 to Tosted Asphalt, Inc, in the award amount of $179,543.03; and,
B. Authorizing the City Manager to execute the necessary documents and to approve change orders not to exceed 10% of the total contract; and,
C. Authorizing the Finance Officer to make necessary budget adjustments.

DISCUSSION
In June 2021, Council adopted a motion to approve a project list for the Road Repair Accountability Act (SB1), Local Streets and Roads Funding. At that time Council allocated $150,000 for R Street Sidewalks Replacement (Childs-13th) for sidewalk and curb & gutter replacement. At that time, Council also allocated $1,000,000 for 18th Street (R St to V St) for roadway and sidewalks rehabilitation.
This project consists of replacing sidewalks on R Street from Child’s Avenue to 13th Street. The scope of work includes, but is not limited to, removal of existing sidewalk, curb and gutter, asphalt concrete, and a diseased 30” diameter tree. The contractor shall install new sidewalk, curb and gutter, paint the new curb red, and new asphalt concrete.
Staff prepared plans and specifications and put project out to bid on February 1, 2024. The bid was split into a base bid consisting of sidewalk replacement from Childs Avenue to North of 4th Street (approximately around 526 R St), and a bid alternate that consisted of sidewalk replacement from North of 526 R Street to 13th Street. Bids were opened on February 29, 2024, with the following results for the base bid:

The lowest responsive bidder on the Base Bid was Tosted Asphalt. Due to the Bid Alternates coming in at a higher amount of $80,001.60, the contractor adjusted their prices on the Bid Alternate to $63,063.91 so that both the base bid and bid alternate could be awarded.

The Engineer’s Estimate was $90,000 - $110,000 for the project. Currently the project only contains sufficient funding for the base bid. Staff is requesting to supplement SB1 funding from Project #CP200003 (18th Street R - V) to award the bid alternate as well.

IMPACT ON CITY RESOURCES
Project CP220024 is established as a Capital Improvement Project and contains sufficient funding to cover the base bid. A budget transfer of $82,498 from Project CP200003 (18th Street R - V), will be initiated after Council approval to cover the funding for the bid alternate.
