Update to the Master license Agreement (“MLA”) Template to utilize City-owned vertical infrastructure within the City’s public right-of-way for small cell telecommunication facilities

 

RECOMMENDATION

City Council- Adopt a motion:

                     

AAuthorizing the City Manager or Deputy City Manager to execute the updated Template for a Master license Agreement (“MLA”); and,

 

B.  Authorizing the City Manager or Deputy City Manager to update the Master License Agreement (“MLA”) to reflect any future changes to State or Federal Legislation.

DISCUSSION

On December 6th, 2021 Council approved a Resolution and approved the use of Master License Agreement Template for the use of the City-owned vertical infrastructure within the City’s public right-of-way for small cell telecommunication facilities.  During the approval process, before the item was brought forward to council, a draft instead of a final copy was attached to the administrative report. The final copy included in this administrative report shall replace the draft copy.  The changes between the versions include updated site licenses charges in the premium terms of the MLA from $760 to $270, paginations corrections, and a spelling correction.

 

As the Master License Agreements (“MLA”) are ten (10) year terms with telecommunication carriers it might be prudent to allow for a seamless mechanism to update the agreement if state or federal laws change. This administrative report, if approved, would authorize the City Manager to make modifications to the Template if state or federal law changes that would put the City Master License Agreement Template in conflicts with new laws.
