SUBJECT: Approval of First Amendment to the Professional Agreement with LPA, Inc., to Conduct a Structural Analysis of the Central Police Station and Assess Programming and Facility Layout for an Additional Cost of $17,500
REPORT IN BRIEF
Consider the approval of the First Amendment to the LPA, Inc. Professional Services Agreement, to conduct a structural analysis of the Central Police Station and assess programming and facility layout for an additional not-to-exceed amount of $17,500.
RECOMMENDATION
City Council - Adopt a motion approving the first amendment to the agreement with LPA, Inc., and authorizing the City Manager or Deputy City Manager to execute the necessary documents.

DISCUSSION
During the fall of 2018, staff conducted a Request for Proposal to evaluate consultants to perform a needs assessment for a future police headquarters.
On January 22, 2019, Council awarded the Needs Assessment contract to LPA, Inc. in partnership with MWL, Inc. in the amount of $165,850.
On September 30, 2019, Council was provided with an update on the Needs Assessment by representatives from LPA, Inc. (lead designer and architect) and MWL Architects (police facility specialists). Council directed staff to work with the consultants on factors influencing the size of the future police headquarters.
In August 2021, Staff met with LPA representatives to identify essential programs that must operate from the Central Police Station, and non-essential programs that could potentially operate in the former UC Merced Venture Lab facility; the facility is currently vacant as of November 2020.
During the discussion, it was determined that the current Central Station may have the available space, combined with the converted non-essential space, to meet the future needs of the department. As a result, a structural analysis of the current Central Police Station is required to be compliant with California’s requirements of the Essential Services Buildings Seismic Safety Act (ESBSSA). To determine growth projections and accommodations, additional services include evaluation of the available space in the Central Station and Venture Lab, programming and building layout, and cost estimate.

With Council’s approval of the First Amendment, the Consultant’s schedule is as follows:
• Structural engineering team to start their analysis immediately and will complete the work in approximately 3-4 weeks.
• Programming will begin concurrently with the structural analysis is well underway.
• Structural and programming analysis will go to the cost estimator in November.
• LPA will provide a report with the analysis, program information, and cost estimate to the City by January 2022.
Currently, $42,625 remains in the existing Professional Services Agreement with LPA, Inc. Should the Council approve the First Amendment which includes $17,500 for the additional services, the total amount to be spent on evaluating the Central Police Station and former Venture Lab facility is $60,125.
During the term of their contract, LPA, Inc., has proven to be a valuable partner for the City of Merced. Staff seeks Council’s approval of the first amendment to the agreement with LPA, Inc., to allow for supplemental consultant services.
IMPACT ON CITY RESOURCES
There is sufficient funding in the FY 2021-22 Police Headquarters Capital Improvement Project (449-1001-627-65-00-116040) to cover the proposed additional expenses.
