REPORT IN BRIEF

Considers approving an agreement for professional services with Black Water Consulting Engineers, Inc. to complete the City’s 2026-2030 UWUO reporting forms required by the State Water Resources Control Board (SWRCB) by January 1st of each year and to support the review and reporting of the City’s CII-LAM-LUCD.

 

RECOMMENDATION

City Council - Adopt a motion:

 

A.  Approving an agreement with Black Water Consulting Engineers, Inc., in the amount not to exceed $97,268 to complete the City’s 2026-2030 UWUO reporting forms required by the SWRCB and to support the review and reporting of the City’s CII-LAM-LUCD; and,

 

B.  Authorizing the City Manager or designee to sign the necessary documents.

Per California Code of Regulations (CCR) Title 23 Section 969(b)(2) and CCR Title 23, Section 973(a)(1).

 

CITY COUNCIL PRIORITIES

As provided for in the FY 2026-2027 Adopted Budget.

 

DISCUSSION

The State Water Resources Control Board (SWRCB) Making Conservation a Way of Life regulation requires each urban retail water supplier to calculate an annual Urban Water Use Objective, compare it with actual water use, and submit the results through the State’s Water Use Efficiency Data Portal by January 1st each year.

 

The regulation also requires the City to identify existing commercial, industrial, and institutional (CII) water users with large landscapes by June 30, 2027, pursuant to CCR, Title 23, Section 973(a)(1). By July 1, 2028, the City must quantify the total irrigated CII landscape area served by dedicated irrigation meters and substantiate the methodology used to calculate that area, pursuant to CCR, Title 23, Section 969(b)(2).

 

To support these requirements, the Department of Water Resources provided the CII-LAM-LUCD dataset for the City to review and validate in preparation for the 2030 UWUO reporting year.

 

In June 2026, the City issued a request for proposals (Attachment 1) to complete the City’s 2026-2030 UWUO reporting forms required by the SWRCB and to support the review and reporting of the City’s CII-LAM-LUCD.  The City received proposals from the following companies:

 

                     Black Water Consulting Engineers, Inc.

                     Spatial Informatics Group, LLC

 

The selection committee’s review of the written proposals, scored and recommended Black Water as the best choice to meet our needs.  Staff reviewed the detailed scope of work and costs presented in Black Water’s proposal and negotiated an Agreement for Professional Services (Attachment 2).

 

IMPACT ON CITY RESOURCES

Sufficient funds were included in the budget for this item and are available in the Water System-Enterprise Fund Professional Services, 60016060 511012, to cover this agreement in the amount $97,268.  No appropriation of funds is needed.
