SUBJECT: Adoption of a Resolution Approving Final Map #5387 for the Mission Ranch, Phase 2 Subdivision for 70 Single-Family Lots, Generally Located at the Southwest Corner of G Street and Rancho Camino Drive, and the Approval of the Subdivision Agreement for the Mission Ranch, Phase 2 Subdivision

Considers the approval of Final Map #5387 for the Mission Ranch, Phase 2 Subdivision for 70 single-family lots, generally located at the southwest corner of G Street and Rancho Camino Drive, and the approval of the subdivision agreement for the Mission Ranch, Phase 2 Subdivision.
RECOMMENDATION
City Council - Adopt a motion:
A. Approving Resolution 2021-80, a Resolution of the City Council of the City of Merced, California, approving the Final Subdivision Map for the Mission Ranch, Phase 2 Subdivision (#5387); and,
B. Approving the Subdivision Agreement for the Mission Ranch, Phase 2 Subdivision; and,
C. Authorizing the City Manager or Deputy City Manager to execute all necessary documents.

3. Approve, subject to modifications as conditioned by Council; or

AUTHORITY
Chapter 24 of Title 18, Subdivisions, of the Merced Municipal Code (MMC) deals with final maps. Section 18.24.120 gives the City Council authority to approve the final map and agreements as long as it is consistent with the Tentative Map.
DISCUSSION
The proposed subdivision (Mission Ranch, Phase 2), is generally located at the southwest corner of G Street and Rancho Camino Drive (Attachment 1). The Mission Ranch Subdivision, Phase 2, Final Map #5387, would approve the subdivision of approximately 7.78 acres into 70 lots south of Rancho Camino Drive (Attachment 2). Phase 2 of the Mission Ranch subdivision continues the small lot design from Phase 1. Phase 2 includes small lots ranging in size between 3,160 to 5,299 square feet.
The subdivision would have two north-south through streets connecting to Rancho Camino Drive. There would also be one north-south cul-de-sac and one east-west street with connection to G Street.
Vesting Tentative Subdivision Map (VTSM) #1315 was approved for this subdivision on December 9, 2020 (Attachment 3). A previously approved tentative map (VTSM #1279) expired before the final map was approved. Thus, a new tentative map was required. In accordance with the Zoning Ordinance, small lot subdivisions are subject to the approval of a Conditional Use Permit. Conditional Use Permit (CUP) #1076 was approved with the previous tentative map, but is not subject to the same expiration dates. Therefore, Mission Ranch, Phase 2 is conditioned to comply with all the same design requirements as Mission Ranch Phase 1 on the north side of Rancho Camino Drive.
The owner/developer, Fortis Construction, has substantially complied with the approved tentative map for this site (Tentative Map #1315), and has complied with the Conditions of Approval listed in Planning Commission Resolution #4053 (Attachment 4), adopted by the Planning Commission on December 9, 2020. The owner/developer has submitted an application for a final map approval in compliance with the Subdivision Map Act and City Subdivision Ordinance. It is now appropriate to approve the Final Map (Attachment 2) and Subdivision Agreement (Attachment 6).
The subdivision was annexed into the Community Facilities District (CFD) for Services (CFD No. 2003-2) as part of Annexation No. 4 in 2007.
City Council Action
The proposed Final Subdivision Map substantially complies with the approved Tentative Map for this site (TSM #1315). Therefore, the City Council should adopt the Resolution found at Attachment 5 approving Final Map #5387 for Mission Ranch, Phase 2 and approve the Subdivision Agreement (Attachment 6) for the subdivision.
