SUBJECT: Adoption of a Resolution Approving the Administering Agency State Program Supplement No. F029 Rev. 1 and Award of Bid to Avison Construction, Inc. for the CMAQ John Muir Sidewalk Project, Project Number 119042, in the Amount of $898,832.00
REPORT IN BRIEF
Considers a resolution approving a California Department of Transportation Program Supplement for the use of $639,449 in CMAQ Grant funding and awarding a construction contract to Avison Construction, Inc. in the amount of $898,832.00 for the CMAQ John Muir Sidewalk Project.
RECOMMENDATION
City Council - Adopt a motion:
A. Adopting Resolution 2022-28, a Resolution of the City Council of the City of Merced, California, approving Federal-Aid Projects Program Supplement Agreement No. F029 Rev. 1; and,
B. Awarding the CMAQ John Muir Sidewalk Project 119042 to Avison Construction, Inc., in the amount of $898,832.00; and,
C. Authorizing the City Manager or Deputy City Manager to execute the necessary documents and to approve change orders not to exceed 10% of the total contract; and,
D. Authorizing the Finance Officer to make necessary budget adjustments.

AUTHORITY
Charter of the City of Merced, Article XI, Section 1109 - Contracts on Public Works, and Merced Municipal Code Chapter 3.04, Article IV - Public Works Contracts.
Caltrans Procedures for Administering Local Grant Projects in the State Transportation Improvement Program (STP) are used to comply with the changes to the programming and funding statutes brought about by Charter 622 of the Statues of 1997 (SB 45, KOPP). The procedures have been modified to remain consistent with and complimentary to the various guidelines and policies adopted by the California Transportation Commission (CTC), including the current 2010 STP Guidelines
(adopted on October 14, 2009).

As provided for in the 2021-22 Adopted Budget.
DISCUSSION
This portion of the project is for construction and installation of approximately 4,000 linear feet of new sidewalk and approximately 24 access ramps on "I" St from the alley South of W 25th St to W 28th St, Martin Luther King Jr Way from W 26th Street to W 28th St, and “K” Street from W 26th Street to W 28th Street. Federal Congestion Mitigation and Air Quality (CMAQ) Grant funding for Construction of the sidewalks was accepted by City Council on January 18, 2022. The Federal-Aid Projects Program Supplement Agreement No. F029 Rev. 1 increases the original supplement agreement by $639,449 in grant funds and a local match of $82,847 toward the construction. Additional local funds will be required in the amount of $327,704.
Staff prepared plans and specifications, and the project was advertised for bids. Bids were opened on, April 26, 2022, with the following results:
1. Avison Construction, Inc., Madera, CA $ 898,832.00
2. Mid Cal Pipeline & Utilities, Inc., Merced, CA $ 980,082.00
3. FBD Vanguard Construction, Inc., Livermore, CA $ 1,152,180.00
4. Dirt Dynasty, Inc., Farmington, CA $ 1,188,296.45
The engineer’s estimate for construction was $700,000.00 to $900,000.00.

IMPACT ON CITY RESOURCES
This project was established as a Capital Improvement Project to be funded by Measure V and CMAQ funds that contain sufficient funding to complete the project.
