SUBJECT: Award Construction Contract to American Paving Co., for the G Street Bridge Repair, Project No. CP230066, in the Amount of $148,400
REPORT IN BRIEF
Considers authorizing to waive the competitive bidding requirements for CP230066 and considers awarding a Construction Contract to American Paving Co., in the amount of $148,400 for the G Street Bridge Repair.
RECOMMENDATION
City Council - Adopt a motion:
A. Waiving the City’s competitive bidding requirement as permitted by Merced Municipal Code Section 3.04.210; and,
B. Awarding the G Street Bridge Repair, Project No. CP230066 to American Paving Co., in the amount of $148,400; and,
C. Authorizing the City Manager to execute the necessary documents and to approve change orders not to exceed 15% of the total contract.

DISCUSSION
G Street Bridge Repair
On October 25, 2022, a vehicle accident occurred on the G Street and Bear Creek bridge causing significant damage to portions of the northeast portion of the bridge railing and sidewalk. A temporary fencing was installed for public safety.
In November 2022, the City hired Dokken Engineering to prepare plans and specifications for bidding to replace the damaged portions of the bridge railing and sidewalk.
The project was initially advertised on July 3, 2023, as a statement of services (Attachment No. 1). The City received one bid from American Paving Co. for $195,062.50, which was above the bidding threshold and had to be rejected.
The project was then readvertised on August 18, 2023, again as a statement of services (Attachment No. 2) with no submittals received.
At this point staff changed the bidding process to a formal bid and advertise the project on March 7, 2024, and March 14, 2024 (Attachment No. 3). The bid opening was scheduled for March 28, 2024, resulting in zero bidders.
The project was then readvertised on August 1, 2024, and August 8, 2024, as a formal bid item (Attachment No. 4). The bids opening was scheduled for August 29, 2024, resulting again in zero bids.
In September 2024, Staff contacted American Paving Co. which provided the City with an original bid of $195,062 on July 3, 2023. American Paving Co. adjusted their price to $148,400.00 to complete the work.
Due to the lack of bidders, staff is requesting Council to wave the competitive bidding process and award the contract to American Paving Co. for this repair.
The Engineer’s estimate was $85,000 - $95,000 for the project. There are sufficient funds for the proposed budget within the project. We will be awarding the contract based on the base bid.

IMPACT ON CITY RESOURCES
Project CP230066 is established as a Capital Improvement Project to be funded by Local Transportation Funding (LTF) and contains sufficient funding to complete this project.
