REPORT IN BRIEF
Considers approving an increase to the contingency in the amount of $6,589.50 for City Project No. 117038 - V Street Improvements, 16th Street to 18th Street and Change Order #4 with Agee Construction Corporation. This increase will be the Final increase for the project in order to close out the project.
RECOMMENDATION
City Council - Adopt a motion authorizing the City Manager or Deputy City Manager to execute the necessary documents and to approve change orders with Agee Construction Corporation up to a total contingency amount of $61,703.03 including an increase in contingency of $6,589.50.

AUTHORITY
Charter of the City of Merced, Article XI, Section 1109 - Contracts on Public Works, and Merced Municipal Code Chapter 3.04, Article IV - Public Works Contracts.
CITY COUNCIL PRIORITIES
As provided for in the 2021-22 Adopted Budget.
DISCUSSION
This increase will be the final increase for the project in order to close out the project. The increase in the contingency for the V Street Improvements - 16th Street to 18th Street project by $6,589.50 is due to the following:
1. Additional AC cutback work required for new driveway transitions.
The initial contingency amount of $55,888.30 was paid to the Agee Construction Corporation for extra work by Change Order #1,2 and 3. The extra work totaled $55,113.53 and consisted of the following:
Change Order1: $32,501.33
1. Additional concrete work,
2. Replace traffic conduit to signal,
3. Add green-thermo bike lane markings,
4. Additional signage, and,
5. Red curbing.
Change Order2: $18,215.85
1. Additional grading, and,
2. Additional cost for increased oil index pricing.
Change Order 3: $4,396.35
1. Install bollards
The following was approved by the City Council on July 6, 2022:
The work to be performed includes but not limited to the grinding and disposal of asphalt paving, Full Depth Reclamation (FDR) installation of 3-inch asphalt paving, ADA ramps, sidewalk, curb & gutter, alley and commercial driveway approaches and traffic markings.
Staff prepared plans and specifications, and bids were opened on June 1, 2021, with a total of six bid submissions:
1. TBS Contractors. $ 702,899.52
2. DOD Construction $ 626,387.75
3. Avison Construction, Inc. $ 566,264.00
4. Machado and Sons $ 719,863.39
5. Agee Construction Corporation $ 558,883.00
6. United Pavement Maintenance, Inc. $ 627,108.37
The engineer’s estimate for construction was $589,571.50

IMPACT ON CITY RESOURCES
This project was established as a Capital Improvement Project to be funded by Measure V, and Sewer Enterprise funds. Funding is available to complete the project.
