SUBJECT: Approval of Additional Contingency in the Amount of $155,460.36 for Additional Work Which is Reflected in the Final Change Order #2 Associated with the N Street Improvements - 16th Street to 18th Street, Project No. 120060 Which will be the Final Increase for the Project in Order to Close out the Project
REPORT IN BRIEF
Considers approving an increase to the contingency in the amount of $155,460.36 for City Project No. 120060 - N Street Improvements, 16th Street to 18th Street. This increase will be the Final increase for the project in order to close out the project.
RECOMMENDATION
City Council - Adopt a motion authorizing the City Manager or Deputy City Manager to execute the necessary documents and to approve change orders up to a total contingency amount of $251,706.30 including an increase in contingency of $155,460.36.

AUTHORITY
Charter of the City of Merced, Article XI, Section 1109 - Contracts on Public Works, and Merced Municipal Code Chapter 3.04, Article IV - Public Works Contracts.
CITY COUNCIL PRIORITIES
As provided for in the 2021-22 Adopted Budget.
DISCUSSION
This increase will be the Final increase for the project in order to close out the project. The increase in the contingency for the N Street Improvements - 16th Street to 18th Street project by $155,460.36 is due to the following items:
1. Removal of 16th Street mid-block crossing,
2. Additional roadway work,
3. Replace sidewalk fronting the Thorington building,
4. Right of way delays,
5. Additional electrical work for Street Lights,
6. Addition of electrical GFI pedestals
7. Replace a damaged window at the Tioga Apt.’s, and,
8. Fill underground tank with pea gravel.
The initial contingency amount of $96,245.94 was paid to the Contractor for extra work by Change Order #1. The extra work totaled $95,500.91 and consisted of the following:
1. Additional irrigation work,
2. Additional electrical work,
3. Thorington building name stamp for sidewalk,
4. Re-install roof drains in sidewalk,
5. Additional concrete demo,
6. Replace utility box, and,
7. Petromat roadway treatment.
The following was approved by the City Council on October 19, 2020:
The work to be done consists of the removal of 3-inches of existing asphalt concrete and installation of a 3-inch asphalt concrete overlay. Additionally, the street will be widened on the west side. The work also includes removal of existing curb & gutter, sidewalk, alley approaches, trees, streetlights, sewer and drainage facilities, and installation of ADA ramps, curb & gutter, sidewalk, alley approaches, trees with tree wells, streetlights, sewer and drainage facilities, additional on-street parking, striping and signage. Parking will be changed from parallel to diagonal.
Staff prepared plans and specifications, and bids were opened on March 23, 2021, with a total of seven bid submissions:

3. Avison Construction, Inc. $ 982,457.00
4. Cal Valley Construction $ 1,022,397.45
5. George Reed, Inc. $ 1,039,096.80
6. United Pavement Maintenance, Inc. $ 1,043,492.00
7. Bush Engineering, Inc. $ 1,089,818.00
The engineer’s estimate for construction was $814,882.20

This project will require the contractor to notify property owners by door hangers and barricades of when work will be done to ensure vehicles are removed from the street.
IMPACT ON CITY RESOURCES
This project was established as a Capital Improvement Project to be funded by Measure V, SB1-LPP, LTF and Sewer Enterprise funds. Funding is available to complete the project.
