RECOMMENDATION

City Council - Adopt a motion:

 

A.  Adopting Resolution 2023-74, a Resolution of the City Council of the City of Merced, California, approving and authorizing the local transportation fund (LTF) claim to be filed with the Merced County Association of Governments (MCAG) for the Coronavirus response and relief supplemental appropriations acts of 2021 (CRRSAA) swap; and,

 

B.  Authorizing filing of the annual LTF claim for the CRRSAA Swap of 2021 for in the amount of $334,037 for Fiscal Year 2022-23 to be filed with the Merced County Association of Governments (MCAG); and,

 

C.  Authorizing the City of Merced City Manager and the City Finance Officer to sign the LTF claim form for the CRRSAA Swap and submit said claim to MCAG for processing; and,

 

D.  Authorizing the Finance Officer to make any necessary budget adjustments.

AUTHORITY

The Transportation Development Act (TDA) of 1971 provides for distribution of Local Transportation Funds (LTF) to local agencies for street and road use, granted there are no unmet transit needs in the presiding county.

 

CITY COUNCIL PRIORITIES

Address Council’s priority for improving local roads, sidewalks, and traffic.

 

DISCUSSION

Local Transportation Funds (LTF) are administered by the State of California and allocated through the Merced County Association of Governments (MCAG).  LTF funds are first designated for identified transit needs, and any remaining balance is apportioned through MCAG to local agencies for non-transit uses, such as streets and roads.  In previous years, the City received an annual allocation determined by a population based formula. This is the seventh year since 2009 that this funding has been available to the City; the City’s entitlement for the 2021-2022 fiscal year was $92,633 and the City already received an entitlement for the 2022-2023 fiscal year in the amount of $77,002.00 that City Council approved claiming at their regularly scheduled meeting on April 3, 2023. MCAG is providing additional LTF funding that the City may claim through resolution for the additional funds.

 

In December of last year, the MCAG Board elected to swap the LTF funding with the Transit Joint Powers Authority (TJPA) for the Coronavirus Response and Relief Supplemental Appropriations Act (CRRSAA) of 2021 funds to cities and county based upon a formula consisting of 25% of the total allotment and the remaining amount by population.  Although MCAG carried out the funding swap, the City may utilize the funds as for any other LTF funding. The City of Merced’s entitlement for the 2022-2023 fiscal year is $334,037. The MCAG Governing Board approved the Apportionment Schedule (attachment 2) at its regular meeting of December 15, 2022.  These funds will be proposed to be used for project CP200044-B Street and Childs Development and project CP240045-Canal&Childs Ave Sidewalk improvement.

 

IMPACT ON CITY RESOURCES

The swapping of the LTF funding with CRRSAA of 2021 allocation was not included In the FY 2022-23 adopted budget.  Staff recommends accepting $334,037 from the Merced County Association of Governments (MCAG) and appropriating $40,000 to project CP200044-B Street and Childs Development and $294,037 to project CP240045-Canal&Childs Ave Sidewalk improvement.
