SUBJECT: Adoption of a Resolution Approving Final Map 5378 (Lantana Estates, Phase 2) for 50 Single-Family Lots, Generally Located at the Northwest Corner of El Redondo Drive and Cassis Drive, and the Approval of the Subdivision Agreement for the Lantana Estates, Phase 2 Subdivision

Considers the approval of Final Map #5378 for 50 single-family lots, generally located at the northwest corner of El Redondo Drive and Cassis Drive, and the Subdivision Agreement for the Lantana Estates, Phase 2 subdivision.
RECOMMENDATION
City Council - Adopt a motion:
A. Adopting Resolution 2021-63, a Resolution of the City Council of the City of Merced, California, approving the Final Subdivision Map for the Lantana South, Phase 2 Subdivision (#5378); and,
B. Approving the Subdivision Agreement for the Lantana Estates, Phase 2 subdivision; and,
C. Authorizing the City Manager or designee to execute all necessary documents.

3. Approve, subject to modifications as conditioned by Council; or
4. Refer back to staff for reconsideration of specific items (specific items to be addressed in City Council motion); or,

AUTHORITY
Chapter 24 of Title 18, Subdivisions, of the Merced Municipal Code (MMC) deals with final maps. Section 18.24.120 gives the City Council authority to approve the final map and agreements as long as it is consistent with the Tentative Map.
DISCUSSION
The proposed subdivision (Lantana Estates, Phase 2), is generally located at the northwest corner of El Redondo Drive and Cassis Drive (Attachment 1). The Lantana Estates, Phase 2, Final Map #5378 would approve 50 lots, all 5,000 square feet or larger (refer to the Final Map at Attachment 2). The Lantana Estates subdivision includes three phases (refer to the location map at Attachment 1). Phase 1 was constructed in 2008, but most of the homes in this phase were constructed in more recent years. The original tentative map for all three phases expired before Phases 2 and 3 were constructed. Therefore, a new Vesting Tentative Subdivision Map (VTSM #1309) was approved for Lantana Estates, Phases 2 and 3 (Attachment 3). Lantana Estates, Phase 2 will construct three east-west cul-de-sacs extending from a north-south street that connects to Cassis Drive (see VTSM #1309 at Attachment 3).
The owner/developer, D.R. Horton CA3, Inc., has substantially complied with the previously approved tentative map for this site (VTSM #1309), and has complied with the Conditions of Approval listed in Planning Commission Resolution #4009 (Attachment 4), adopted by the Planning Commission on October 3, 2018. The owner/developer has submitted an application for a final map approval in compliance with the Subdivision Map Act and City Subdivision Ordinance. It is now appropriate to approve the Final Map (Attachment 2) and Subdivision Agreement (Attachment 6).
The entire Lantana subdivision was annexed into the Community Facilities District (CFD) for Services (CFD No. 2003-2) as part of Annexation No. 4 in 2007.
City Council Action
The proposed Final Subdivision Map substantially complies with the approved Tentative Map for this site (VTSM #1309). Therefore, the City Council should adopt the Resolution found at Attachment 5 approving Final Map #5378 for Lantana Estates, Phase 2 and approving the Subdivision Agreement (Attachment 6) for the subdivision.
