SUBJECT: Adoption of a Resolution Approving Final Map #5396 for Sage Creek, Phase 1 Subdivision for 26 Single-Family Lots, Generally Located South of Cardella Road (Extended) Between El Redondo Drive (Extended) and Horizons Avenue (Extended) and the Approval of the Subdivision Agreement for the Sage Creek, Phase 1 Subdivision

Considers the approval of Final Map #5396 for 26 single-family lots, located south of Cardella Road (extended) between El Redondo Drive (extended) and Horizons Avenue (extended), and the subdivision agreement for the Sage Creek, Phase 1 Subdivision.
RECOMMENDATION
City Council - Adopt a motion:
A. Approving Resolution 2022-26, a Resolution of the City Council of the City of Merced, California, approving the Final Subdivision Map for the Sage Creek, Phase 1 Subdivision (#5396); and,
B. Approving the Subdivision Agreement for the Sage Creek, Phase 1 Subdivision; and,
C. Authorizing the City Manager or the Deputy City Manager to execute all necessary documents.

3. Approve, subject to modifications as conditioned by Council; or

AUTHORITY
Chapter 24 of Title 18, Subdivisions, of the Merced Municipal Code (MMC) deals with final maps. Section 18.24.120 gives the City Council authority to approve the final map and agreements as long as it is consistent with the Tentative Map.
DISCUSSION
The proposed subdivision (Sage Creek, Phase 1), is generally located on the south side of Cardella Road between El Redondo Drive (extended) and Horizons Avenue (extended) (Attachment 1). The Sage Creek Phase 1, Final Map #5396 would approve 26 single-family lots and a Remainder Parcel (refer to the Final Map at Attachment 2). The Sage Creek tentative subdivision map approved 103 single-family lots which would be developed in two phases (Attachment 3). However, Benchmark Engineering has been able to add an additional lot with Phase Two for a total of 104 lots within the subdivision. The lots within the Sage Creek subdivision would range in size from approximately 4,300 square feet to approximately 5,700 square feet.
As described above, Phase 1 will construct 26 lots and the Remainder lot shown on the final map at Attachment 2 will be subdivided into 78 lots with a separate final map for Sage Creek, Phase 2. As part of the Final Map, the 8-foot-wide Public Utilities Easement (PUE) on the east side of El Redondo Drive will be vacated. This area will be re-dedicated as part of the right-of-way (instead of an easement) for El Redondo Drive.
The owner/developer, Stonefield Home, Inc., has substantially complied with the approved tentative map for this site (Tentative Map #1313), and has complied with the Conditions of Approval listed in Planning Commission Resolution #4045 (Attachment 4), adopted by the Planning Commission on August 19, 2020. The owner/developer has submitted an application for a final map approval in compliance with the Subdivision Map Act and City Subdivision Ordinance. It is now appropriate to approve the Final Map (Attachment 2) and Subdivision Agreement (Attachment 6).
The subdivision was annexed into the Community Facilities District (CFD) for Services (CFD No. 2003-2) as part of Annexation No. 20 on May 2, 2022.
City Council Action
The proposed Final Subdivision Map substantially complies with the approved Tentative Map for this site (TSM #1313). Therefore, the City Council should adopt the Resolution found at Attachment 5 approving Final Map #5396 for the Sage Creek Phase 1 Subdivision and approve the Subdivision Agreement (Attachment 6) for the subdivision.
