Considers accepting $80,896 in Post-Programming CMAQ Carryover Apportionment for construction of sidewalks on Parkwest Street between Woodward Avenue and Windsor Avenue; McGregor Street between Home Avenue and Stuart Drive; Windsor Avenue between Parkwest Street and South R Street, Woodward Avenue between Parkwest Street and South R Street, and Home Avenue between Parkwest Street and McGregor Street.

 

RECOMMENDATION

City Council - Adopt a motion:

 

A.  Accepting Post-Programming CMAQ Carryover Apportionment funds in the amount of $80,896; and,

 

B.  Approving a budget amendment increasing revenue in Fund 5005-Street and Signal CIP in the amount of $80,896 and appropriating the same to Project No. CP220064 for costs associated with the construction of sidewalks on Parkwest Street, McGregor Street, Windsor Avenue, Woodward Avenue, and Home Avenue; and,

 

C.  Approving the use of pooled cash until reimbursement is received from the grant; and,

 

D.  Authorizing the City Manager to execute the necessary documents.

Caltrans Procedures for Administering Local Grant Projects in the State Transportation Improvement Program (STP) are used to comply with the changes to the programming and funding statutes brought about by Charter 622 of the Statutes of 1997 (SB 45, KOPP). The procedures have been modified to remain consistent with and complimentary to the various guidelines and policies adopted by the California Transportation Commission (CTC), including the current 2010 STP Guidelines

(adopted on October 14, 2009).

 

CITY COUNCIL PRIORITIES

As provided for in the 2024-2025 Adopted Budget.

 

DISCUSSION

In June 2021, the City applied for Congestion Mitigation and Air Quality Improvement (CMAQ) funds to design and construct 5-foot sidewalks to provide connectivity along McGregor Street, Windsor Avenue, Home Avenue, Woodward Avenue, and Parkwest Avenue to fill a sidewalk gap that currently exists. ADA ramps will be installed where necessary.

 

In August 2022, Council accepted Federal-Aid Projects Program Supplement Agreement No. 037-F to allow $35,172 in grant funds and a local match of $4,557 toward the Preliminary Engineering of the project allowing for design, preparation of engineering plans and specifications, and environmental review.

 

Appropriation was made at the August 5, 2024, Council Meeting for accepting CMAQ grant funds in the amount of $404,479 for Construction costs associated with installation of sidewalks and ADA ramps.

 

Staff prepared plans and specifications, the project was advertised for bids, and City Council awarded the project to Kroeker, Inc., in the amount of $790,216.60 on January 21, 2025.

 

Due to increased costs for labor and materials, the project had a shortfall of $511,467.51. Staff transferred $511,468 of Measure V funding from CP250023 (Measure V Local Transportation - Projects to be Determined) to supplement the project, while requesting additional funding from Merced County Association of Governments (MCAG). 

 

At the request of the Engineering Department, Merced County Association of Governments approved the usage of the Region’s CMAQ Carryover Apportionment in the amount of $80,896 to supplement the construction phase of the installation of sidewalks on Parkwest Street, McGregor Street, Windsor Avenue, Woodward Avenue, and Home Avenue.

 

The CMAQ post program funding amount of $80,896 requires a local match of $252,437.  After City Council accepts this apportionment, any unused Measure V Funding will be transferred back to CP250023 (Measure V Local Transportation - Projects to be Determined).

 

IMPACT ON CITY RESOURCES

Project CP220064 was established as a Capital Improvement Project to be funded by Measure V and CMAQ funds. There are sufficient funds to complete this project.

 

Recommendation B will require an affirmative vote of 5 council members to pass.
