SUBJECT: Supplemental Appropriation from General Fund, FY 14/15 Fund Balance for Contract City Attorney Services

 

REPORT IN BRIEF

A supplemental appropriation is required to reimburse Best, Best, & Krieger, Attorneys at Law for services rendered.

 

RECOMMENDATION

City Council - Adopt a motion authorizing a supplemental appropriation from the General Fund, FY 14/15 Fund Balance to Account 001-0301-512.17-00 (Professional Services) in the amount of $7,973.90 to reimburse Best, Best, & Krieger, Attorneys at Law for services rendered and not anticipated in the original contract.

AUTHORITY

Charter of the City of Merced, Article XI Fiscal Administration, Section 1105 Budget - Appropriations, at any meeting after the adoption of the budget, the City Council may amend or supplement the budget by the affirmative vote of at least five members.

 

CITY COUNCIL PRIORITIES

As provided for in the 2014-15 Adopted Budget.

 

 

 

DISCUSSION

The City Council retained the law firm of Best, Best, & Krieger (BB&K) to provide services as the City Attorney after the resignation of prior City Attorney, Gregory Diaz.  The original contract provided for services through the end of January 2015, however there were some issues which overlapped the appointment of Randolph Hom as City Attorney in February 2015 and were continued by BB&K with the knowledge and consent of City Manager John Bramble and Mr. Hom.

 

In addition to those services, at approximately the same time an extensive Public Records Act request was filed with the City which required extensive legal review.  It was determined that BB&K was best suited to provide the necessary review.

 

As a result of the above, for services rendered, BB&K has invoiced the City a total of $7,973.90.  $4,079.00 for completion of general services BB&K started and was requested to complete and $3,894.90 for services related to the Public Records Act request.

 

IMPACT ON CITY RESOURCES

FY 14/15 Ending Fund Balance will be reduced by the amount necessary to pay BB
&K for services rendered in the performance of their duties.
