DISCUSSION
On June 28, 2024, the United States Supreme Court issued a decision in City of Grants Pass, Oregon v. Johnson, 144 S. Ct. 2202 (2024) holding that a municipality's enforcement of an ordinance banning camping on public property is not a constitutional violation of the 8th Amendment's prohibition against cruel and unusual punishment.
The proposed ordinance amendment addresses the concerns regarding public safety, health and safety, efficient movement of public and vehicle traffic, and peaceable enjoyment of public spaces within the City of Merced.
On October 21, 2024, the City Council reviewed a draft of the proposed changes to this Chapter. The City Council requested changes to the draft ordinance.
