DISCUSSION

The Ninth Circuit Court of Appeals previously held that cities cannot enforce anti-camping ordinances if they do not have enough homeless shelter beds available for their unhoused population.  See Martin v. Boise 920 F.3d 584 (2018).

 

However, a recent Supreme Court case, City of Grants Pass, Oregon v. Johnson, 144 S. Ct. 2202 (2024), reviews the decision in Martin v. Boise, and creates a new set of criteria for enforcement of anti-camping ordinances.
