SUBJECT: Public Hearing - Consider Issuing a Certificate of Public Convenience and Necessity to Titan Security Service

 

REPORT IN BRIEF

Hold a Public Hearing to consider issuing a certificate of Public Convenience and Necessity to Titan Security Service to permit the operation of a private security/patrol company within the City of Merced.

 

RECOMMENDATION

City Council - Adopt a motion adopting Resolution 2017-30, a Resolution of the City Council of the City of Merced, California, granting a Certificate of Public Convenience and Necessity to Titans Security Service.

AUTHORITY

Section 5.40.020 of the Merced Municipal Code (MMC) requires that before any person, either as a principal or agent, can operate a private security/patrol company within the City of Merced, the City Council must approve and issue a Certificate of Public Convenience and Necessity to the principal owners of the private patrol and security company. Pursuant to Section 5.40.060 of the MMC, a Public Hearing must be held and the City Council must declare, by resolution, that the public convenience and necessity require the proposed private patrol service.

DISCUSSION

The City received a business license application from Titans Security, a private security firm requesting to do business within the City of Merced. In order to operate as a private security or patrol company within the City of Merced, the applicant must first be issued a Certificate of Public Convenience and Necessity.

 

Titans Security is a licensed security contractor based out of Reedley that provides security services throughout the Central Valley area.  A background check has been completed, and the company has no disciplinary actions against it from the governing board at the State Department of Consumer Affairs. It has been determined that the applicant has met the necessary requirements of section 5.40.030 of the MMC, which outlined below as follows:

 

Requirement 5.40.030 A- Five Year Work History

 

                     The applicant worked for Leon Security in Tulare as a security guard from January 2012 to November of 2015.

                     The applicant worked as the manager for California Security Patrol from March 2014 to February 2016.

                     The applicant has been the owner of Titans Security since May of 2016.

 

Requirement 5.40.030 B- The Territory of the City In Which the Applicant Desires to Work

 

                     The applicant requested permission to work throughout the City of Merced.

 

Requirement 5.40.030 C- The Hours of Patrol

 

                     The hours of service vary due to the nature of the business.

 

Requirement 5.40.030 D- The Address of the Principal Place of Business

 

                     The applicant’s principal place of business is 564 N. Hollywood Drive, Reedley, CA 93654.

 

Requirement 5.40.030 E- Whether the Applicant Holds A License Issued by the State Under the Provisions of the Private Investigator and Adjustor Act

 

                     The applicant holds a state-issued license under the provisions of the Private Investigator and Adjuster Act, License Number 119777.

 

Requirement 5.40.030 F- Prior Criminal History

 

                     A background check was completed and the applicant passed a LiveScan background check.

                     Titans Security is not a corporation. 

 

A Notice of Public Hearing was published on May 11, 2017, in the Merced County Times regarding the Application for Certification of Public Convenience and Necessity.

 

This Administrative Report serves as notice that the following investigation has been completed for the application of Titans Security and has been forwarded to the City Council for consideration of issuance of a Certificate of Public Convenience and Necessity.
