SUBJECT: Award a Construction Contract to FBD Vanguard Construction, Inc., in the Amount of $114,628.88 for the Community Development Block Grants South Merced ADA Ramps, Project No. 117007
REPORT IN BRIEF
Consider awarding a construction contract in the amount of $114,628.88 for the Community Development Block Grants (CDBG) South Merced ADA Ramps Project in Merced.
RECOMMENDATION
City Council - Adopt a motion:
A. Awarding the base bid for the CDBG South Merced ADA Ramps Project 117007 to FBD Vanguard Construction, Inc., in the amount of $114,628.88;
B. Authorizing the City Manager or Assistant City Manager to execute the necessary documents and to approve change orders not to exceed 10% of the total contract;
C. Authorizing the Interim Finance Officer to make necessary budget adjustments to fund this project.

AUTHORITY
Charter of the City of Merced, Article XI, Section 1109 - Contracts on Public Works, and Merced Municipal Code Chapter 3.04, Article IV - Public Works Contracts.

DISCUSSION
The work to be done consists, in general, of the removal and installation of ADA ramps, sidewalk, curb and gutter, asphalt paving, striping and markings. The project is located at “Q” Street and 9th Street, within the City of Merced.
Staff prepared plans and specifications, and the project was advertised for bids in August 2017. The Specification stated that the bid is to be awarded based on the lowest Base Bid. Bids were opened on September 19, 2017, with the following results:

The engineer’s estimate for construction was $111,127.00. The City received two additional Alternate Bids from all three bidders, but rejected the Alternates due to limited funding. Based on the Base Bid, staff recommends awarding the project to FBD Vanguard Construction, Inc., in the amount of $114,628.88.
The project is funded primarily with CDBG Funds. Measure V Funds will be used for the additional funding needed. A subsequent item will come forward for consideration by the City Council to appropriate Measure V funds on December 4, 2017. The following is the proposed budget for the project:

HISTORY AND PAST ACTIONS
On April 3, 2017, City Council approved an Interdepartmental Cooperative Agreement between the departments of Development Services and Economic Development in the amount of $133,410 for the design and construction of the CDBG South Merced ADA Ramps Project.
On August 7, 2017, City Council approved to increase the program funding by $14,190. Accordingly, the Cooperative Agreement will require an Amendment to reflect the approved increase. Presently, the City is waiting on receipt of the funding letter from HUD to proceed with processing and approving the Amendment.
IMPACT ON CITY RESOURCES
Funding for project 117007- CDBG South Merced ADA Ramps is available within fiscal year 2017-18 adopted budget.
