REPORT IN BRIEF
Considers approving the agreement for use of City right-of-way with the County of Merced to allow fencing, landscape, and irrigation in the City right-of-way near the new County mental health building.
RECOMMENDATION
City Council - Adopt a motion approving the agreement for use of City right-of-way with the County of Merced; and, authorizing the City Manager or Assistant City Manager to execute the necessary documents.

DISCUSSION
The County of Merced (County) has finished constructing the new Behavioral Health and Recovery Services Main Campus at the former Mercy Medical Center, located at 301 E. 13th Street. The project is located between 13th Street and 15th Street near D Street. The area is frequented by transients and has an elevated vandalism rate. To reduce vandalism and to better protect the public using the facility, the County of Merced proposed to construct a wrought-iron fence in the City right-of-way.
The County approached staff in March 2018, requesting permission to go forth with installing the fence, landscape, and the irrigation to avoid delays and additional cost for construction.
