Chapter 2.5 (commencing with Section 53311) of Part 1 of Division 2 of Title 5 of the California Government Code (the "Act"), commonly known as the "Mello-Roos Community Facilities Act of 1982," and the City's Policy on new development.
DISCUSSION
PG&E submitted a petition to annex their new service center located at the northwest corner Childs Avenue and Kibby Road (Attachment 1) into the City's Community Facilities District (CFD) No. 2003-2 (Services). On July 6, 2020, the City Council adopted Resolution No. 2020-42 (Attachment 2) declaring its intent to hold a public hearing and election for Annexation No. 13 into Community Facilities District (CFD) No. 2003-2 (Services) for the PG&E Service Center.
It was recently brought to the City's attention, that because PG&E is a public utility agency, they may need approval from the Public Utilities Commission (PUC) prior to voting in the CFD election.
