REPORT IN BRIEF

Considers approving the Restated Joint Powers Agreement of the MCAG.

 

RECOMMENDATION

City Council - Adopt a motion: 

 

A.  Approving the Restated Joint Powers Agreement of the MCAG; and,

 

B.  Authorizing the City Manager or Deputy City Manager to execute the

agreement.

DISCUSSION

MCAG is a joint powers authority that has been in existence since November 28, 1967.  MCAG’s member agencies are the County of Merced and cities of Atwater, Dos Palos, Gustine, Livingston, Los Banos, and Merced.  MCAG’s functions include, but are not limited to, serving as the Regional Transportation Planning Agency pursuant to California law and the Metropolitan Planning Organization pursuant to federal law.

 

The current Joint Powers Agreement will expire on July 18, 2023.  The City Attorney, in consultation with the City Council, has collaborated with legal counsel for the other MCAG member agencies over the past few months to draft revisions to the agreement.  The Board of Supervisors of the County of Merced approved the Restated Joint Powers Agreement at its meeting on April 4, 2023.  The City Councils of the cities of Dos Palos and Livingston will consider approval of the agreement on April 18, 2023.
